Terms and Conditions

By placing an order with Oski Marketing Ltd, you confirm that you agree to and are bound by the terms and conditions outlined below. Please review these terms carefully before placing an order with Oski Marketing Ltd.

Definitions

The Client: The company or individual requesting services from Oski Marketing Ltd.
Oski Marketing Ltd / Developer: The primary designer, site owner, employees, or affiliates.

General Terms

Oski Marketing Ltd will undertake work only when an agreement has been confirmed via email, telephone, mail, or other written communication. Once development begins, any changes or additions to the agreed tasks and schedules will require negotiation and written confirmation.

If a proposal is accepted but does not fully specify the level or type of work required, Oski Marketing Ltd reserves the right to charge for any additional work beyond the original brief.

Oski Marketing Ltd will only provide services to clients aged 18 or above. An order constitutes a written or verbal contract between Oski Marketing Ltd and the client, including telephone and email agreements.

Website Design

While every effort will be made to ensure that websites, scripts, and programs are free of errors, Oski Marketing Ltd is not responsible for any losses resulting from malfunctions of the website or any part thereof.

All website designs, graphics, and programming code remain the property of Oski Marketing Ltd until all outstanding payments are made in full.

Any scripts, PHP scripts, or software created by Oski Marketing Ltd remain its intellectual property and may not be commercially reproduced or resold without explicit permission.

Clients are responsible for ensuring they have the right to use any copyrighted materials submitted for inclusion in their project. Oski Marketing Ltd reserves the right to refuse copyrighted materials unless sufficient proof of permission is provided.

Oski Marketing Ltd is not liable for any costs, losses, or compensation due to failure to meet deadlines, website unavailability, disputes between site owners and their clients, or any other issues arising from the project.

A 50% deposit is required before any design work begins. For small artwork projects (up to £50), payment is required upon completion and before source materials are released. Printing orders must be paid in full before materials are sent for printing.

Final payment is due once the website is completed. Non-payment will result in legal action if necessary. No refunds will be issued once full payment is made.

All quotations are valid for 14 days from the date of issue. Prices are exclusive of VAT.

Oski Marketing Ltd reserves the right to include development credits and links within any code created and to feature completed work in its portfolio.

Database, Application, and E-Commerce Development

Oski Marketing Ltd is not responsible for any losses resulting from the use of software developed for the client. The client must test all applications and programming before deployment. While Oski Marketing Ltd will make reasonable efforts to fix bugs, it is not obligated to correct issues post-launch unless otherwise agreed.

If applications are developed on third-party servers, the client is responsible for ensuring the necessary environment for correct functionality.

Compatibility

Oski Marketing Ltd aims to ensure that websites function correctly on their initial hosting servers and are compatible with major browsers, including Mozilla Firefox, Google Chrome, and Opera. Compatibility with Microsoft Internet Explorer 9 and older versions is not guaranteed.

Website Hosting

Oski Marketing Ltd may recommend third-party hosting services but is not liable for downtime, interruptions, or losses incurred due to hosting issues. Clients are responsible for domain name, hosting, and email service compliance.

Oski Marketing Ltd reserves the right to refuse projects containing offensive, illegal, or controversial content.

Website Optimization

Due to ever-changing search engine algorithms, Oski Marketing Ltd cannot guarantee specific search rankings. While optimization services aim to improve visibility, results may vary, and refunds are not available for these services.

Payment of Accounts

A 50% deposit is required before work begins, with full payment due within 5 days of invoice receipt unless otherwise arranged. Failure to comply with the payment schedule may result in service suspension or legal action.

If payment is not received within 14 days, Oski Marketing Ltd will consider the account in default. Continued non-payment will result in legal proceedings, including potential county court judgments (CCJs).

Termination

Either the client or Oski Marketing Ltd may terminate a project upon mutual agreement. All completed work will be billable at the time of termination, and all intellectual property rights remain with Oski Marketing Ltd unless fully paid.

Clients must submit termination requests in writing. Telephone requests will not be honored until confirmed in writing. Any completed work must be paid in full within 30 days of cancellation notice.

Privacy Policy

Oski Marketing Ltd does not share or sell client information without express consent. Clients will only be contacted for work-related matters.

Complaints Procedure

Informal Resolution

Clients experiencing service issues should contact Oski Marketing Ltd through the online contact form, providing sufficient details to locate and address the complaint.

Formal Complaints

If an issue is not resolved informally, clients may submit a formal complaint in writing. An initial response will be provided within 7 days, with a full response within 30 days.
